Terms of Service

These Terms of Service ("Terms") govern your use of Earling Labs Ringer, a missed-call and lead-capture service for trade contractors provided by Earling Labs LLC, a Minnesota limited liability company ("we," "us," "our"). By using the service, you agree to these Terms.
1. Acceptance of terms
By submitting a lead intake form, signing up as a contractor, or otherwise using any feature of Earling Labs Ringer, you acknowledge that you have read and agree to be bound by these Terms and our Privacy Policy.
2. Description of service
Earling Labs Ringer is software that helps contractors catch and follow up on customer inquiries. Depending on how a contractor sets it up, it can:
- Lead forms: capture service requests through a contractor's web lead form (shareable link and QR code) and generate AI-powered summaries and rough price ranges for the contractor.
- Voice answering & AI booking: answer calls the contractor misses with an AI voice receptionist that takes the caller's details and, where the contractor has connected Earling Labs Scheduler, books a visit into an open time slot.
- AI chat & SMS replies: reply to homeowners with an AI assistant in a chat on the lead page and, where enabled and consented to, by text message.
- Notifications: send lead alerts to contractors by text, email, and browser push, and send transactional texts to homeowners who have opted in.
The AI assistant is instructed never to claim to be a person, and the default call greeting says it is an AI assistant. See our AI Disclosure for details.
3. SMS & text messaging terms
If you check the optional SMS consent box on an Earling Labs Ringer form, you consent to receive transactional SMS messages about your request from the contractor's business, sent by Earling Labs Ringer on the contractor's behalf. Consent is not a condition of any purchase or service; you can submit a form without checking the box. If you call a contractor's Ringer line and the call ends without a visit being booked, you may receive a single follow-up text inviting you to reply.
- Message frequency: varies based on activity; typically up to 10 messages per request.
- Carrier charges: Msg & data rates may apply.
- Opt-out: Reply STOP at any time to unsubscribe.
- Help: Reply HELP for assistance.
- Mobile carrier liability: Mobile carriers are not liable for delayed or undelivered messages.
4. Acceptable use
You agree not to use the service to:
- Send unsolicited messages, spam, or marketing without consent.
- Harass, threaten, or mislead any person.
- Violate any applicable law, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
- Submit phone numbers you do not have permission to contact.
5. Contractor account responsibilities
Contractors using Earling Labs Ringer are responsible for:
- Maintaining accurate business information.
- Ensuring all phone numbers added to the system have appropriate consent.
- Responding to homeowner inquiries promptly and professionally.
- Maintaining the confidentiality of their account credentials.
6. Billing, cancellation & refunds
Contractor accounts are billed under the Earling Labs Terms of Service, which govern subscriptions, billing, cancellation, and refunds; where those terms conflict with these Ringer terms for a contractor account, the Earling Labs Terms of Service control. In summary:
- Plans: Ringer is included in every Earling Labs plan — Starter ($199/mo), Pro ($299/mo), and Crew ($499/mo). Annual plans are billed at eleven months for twelve (Starter $2,189/yr, Pro $3,289/yr, Crew $5,489/yr). Plans are billed per business, not per user. Current pricing is on earlinglabs.com.
- Renewal: subscriptions renew automatically at the end of each monthly or annual period until cancelled. Billing runs through Stripe; we do not store your full card number. Applicable sales tax is added where required.
- Price changes: we give 30 days' notice by email, and a change takes effect at your next renewal, never mid-period.
- Failed payments: we retry and notify you. Access may be suspended if an invoice stays unpaid.
- Cancellation: cancel any time from your billing account at billing.earlinglabs.com or by emailing support@earlinglabs.com. You keep access until the end of the period you have already paid for.
- Refunds: we do not refund or prorate partial periods. If we close your account without cause, we refund the unused portion of any prepaid period. Founding Member payments have their own 14-day refund window, described in the Earling Labs Terms of Service and the Founding Member Customer Agreement.
- Your data: you can export your leads and contacts (CSV) from the dashboard before your access ends.
Homeowners who submit a lead form or call a contractor's Ringer line are never charged by Earling Labs.
7. AI-generated content
Earling Labs Ringer uses AI to summarize lead descriptions, suggest rough price ranges, answer calls, and reply to homeowners by chat or text. AI output is generated on a best-effort basis and may contain inaccuracies, omissions, or misinterpretations, and appointments booked by the AI should be confirmed by the contractor. Contractors should always review the original lead details before acting on a summary or estimate.
8. Service availability
We make reasonable efforts to keep the service available, but do not guarantee uninterrupted operation. The service may be unavailable due to maintenance, third-party outages (including Twilio, Anthropic, or hosting providers), or other factors outside our control.
9. Disclaimers
The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not guarantee message delivery, uptime, accuracy of AI summaries, or fitness for any particular purpose.
10. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from your use of the service is limited to the fees you paid us in the prior three months, or fifty US dollars ($50), whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless Earling Labs Ringer and its operator from any claims arising from your misuse of the service, your violation of these Terms, or your violation of any third party's rights.
12. Termination
You may stop using the service at any time; to end a paid subscription, cancel as described in section 6. We may suspend or terminate accounts that violate these Terms, that we believe pose a risk to other users, or for any reason at our discretion.
13. Governing law
These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the service shall be resolved in the state or federal courts located in Minnesota.
14. Changes to these terms
We may update these Terms from time to time. The effective date at the top reflects the most recent update. Continued use of the service after changes constitutes acceptance of the revised Terms.
