Terms of Service

These Terms of Service ("Terms") govern your use of Earling Labs Ringer, a lead intake notification service operated by George Phillips as a sole proprietorship based in Minnesota, USA ("we," "us," "our"). By using the service, you agree to these Terms.
1. Acceptance of terms
By submitting a lead intake form, signing up as a contractor, or otherwise using any feature of Earling Labs Ringer, you acknowledge that you have read and agree to be bound by these Terms and our Privacy Policy.
2. Description of service
Earling Labs Ringer provides software that captures inbound service requests through web forms, generates AI-powered summaries of those requests, and delivers SMS notifications to contractors and the homeowners who submitted them.
3. SMS & text messaging terms
By submitting your phone number through any Earling Labs Ringer form, you consent to receive transactional SMS messages from the contractor's business or from Earling Labs Ringer on the contractor's behalf.
- Message frequency: varies based on activity; typically 1–5 messages per lead inquiry.
- Carrier charges: Msg & data rates may apply.
- Opt-out: Reply STOP at any time to unsubscribe.
- Help: Reply HELP for assistance.
- Mobile carrier liability: Mobile carriers are not liable for delayed or undelivered messages.
4. Acceptable use
You agree not to use the service to:
- Send unsolicited messages, spam, or marketing without consent.
- Harass, threaten, or mislead any person.
- Violate any applicable law, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
- Submit phone numbers you do not have permission to contact.
5. Contractor account responsibilities
Contractors using Earling Labs Ringer are responsible for:
- Maintaining accurate business information.
- Ensuring all phone numbers added to the system have appropriate consent.
- Responding to homeowner inquiries promptly and professionally.
- Maintaining the confidentiality of their account credentials.
6. AI-generated content
Earling Labs Ringer uses AI to summarize lead descriptions. AI summaries are generated on a best-effort basis and may contain inaccuracies, omissions, or misinterpretations. Contractors should always review the original lead description before acting on a summary.
7. Service availability
We make reasonable efforts to keep the service available, but do not guarantee uninterrupted operation. The service may be unavailable due to maintenance, third-party outages (including Twilio, Anthropic, or hosting providers), or other factors outside our control.
8. Disclaimers
The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not guarantee message delivery, uptime, accuracy of AI summaries, or fitness for any particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from your use of the service is limited to the fees you paid us in the prior three months, or fifty US dollars ($50), whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages.
10. Indemnification
You agree to indemnify and hold harmless Earling Labs Ringer and its operator from any claims arising from your misuse of the service, your violation of these Terms, or your violation of any third party's rights.
11. Termination
You may stop using the service at any time. We may suspend or terminate accounts that violate these Terms, that we believe pose a risk to other users, or for any reason at our discretion.
12. Governing law
These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the service shall be resolved in the state or federal courts located in Minnesota.
13. Changes to these terms
We may update these Terms from time to time. The effective date at the top reflects the most recent update. Continued use of the service after changes constitutes acceptance of the revised Terms.
